Sub-decree on Management of Commercial Advertising on Products and Services
The Royal Government promulgated the Sub-decree on Management of Commercial Advertising on Products and Services on 4th November 2022.
– Application of the Sub-decree
The Sub-decree states that advertisements for products and services are forms and manners including audio-visual media, audio broadcasting, LED screen, website, email, newspapers, magazines flyers, packaging etc. (Article 8), and that the Sub-decree shall apply to such advertisements of products or services (Article 2).
– Regulations on Description and Content of Advertisements
According to the Sub-Decree, the Khmer language expressed in the Khmer language and letters. If a foreign language is used, the Khmer language shall be written above the foreign language and its font size shall be at least twice the size of the foreign language (Article 9).
In addition, commercial advertisements must not use misleading, deceptive, or potentially confusing expressions regarding the quality or safety of products or services, and must not use expressions such as “best”, “only one”, “superior” or “unparalleled” as a general rule (Article 17).
– License from the regulatory authorities
The Sub-decree stipulates that a person who advertises products or services shall apply for advertising license/permit in accordance with applicable laws and regulations in force (Article 10 and 11).
– Regulations on Advertisements with Prize
The Sub-decree classifies commercial advertisements into two categories: advertisements with prize and advertisements without prize (Article 6).
A person who advertises with a prize shall submit to the ministry or agency in charge information on: the product or service with prize, type and price of the prize, the duration of the prize, the place of provision of the prize and the winner’s personal information (Article 7).
– Penalties
The Sub-decree stipulates that a violation of the obligations stipulated by the Sub-decree shall be subject to written warning, suspension, revocation or cancellation of advertising license and/or certificate of commercial advertising, and suspension, revocation or cancellation of certificate of business registration, or license or permit of business services (Article 19).
